Hospitals and medical systems that move infectious substances and regulated medical waste must follow a detailed federal compliance regime under the U.S. Department of Transportation’s Hazardous Materials Regulations (HMR). The rules, codified in 49 CFR Parts 171–180, require shippers to classify, package, label and train personnel according to the risk posed by the material. The framework is designed to prevent unreasonable risks to health, safety and property during commercial transport.

Federal rules cover commercial transport

The Hazardous Materials Regulations apply to materials that may pose an an unreasonable risk to health, safety or property in commerce. For medical institutions, that means infectious substances and regulated medical waste are not routine cargo; they are federally regulated hazardous materials.

The DOT framework requires shippers to classify each material, select compliant packaging, apply required markings and labels, and ensure that staff are trained for the task. Those obligations are detailed in 49 CFR Parts 171–180.

Two categories sort infectious substances by risk

Since the Pipeline and Hazardous Materials Safety Administration (PHMSA) issued its final rule on June 1, 2006, infectious substances have been divided into two main categories. The system aligns with international standards and is intended to match packaging and transport methods to the level of hazard.

Category Definition Risk profile
Category A Known or expected to contain pathogens that can cause permanent disability, life-threatening illness or fatal disease after exposure. High risk
Category B Known or expected to contain pathogens but does not meet the Category A definition. Moderate risk

Category A materials are subject to the most stringent controls. Category B materials carry a lower risk profile but remain regulated.

Packaging and labeling duties depend on the material

Packaging is central to compliance. The regulations set specific references for each category of infectious substance and for regulated medical waste.

  • Category A substances must meet the packaging requirements in §173.196.
  • Category B substances may be exempt from other HMR requirements if they satisfy §173.199.
  • Regulated medical waste must follow the packaging requirements in §173.197.
  • Label exemption: regulated medical waste transported by a private or contract motor carrier may be exempt from the “INFECTIOUS SUBSTANCE” label if its outer packaging is marked “BIOHAZARD” in accordance with 29 CFR 1910.1030.

The label exemption does not remove the need to meet other applicable packaging, marking and handling rules.

Training requirements extend to all involved staff

Employees who package or transport infectious substances must receive specialized training that meets §172.704. The training is intended to ensure that workers can recognize risks and follow correct safety procedures during handling and transport.

Frequently Asked Questions

How is medical waste classified as Category A or Category B?
Classification depends on the severity of health effects after exposure. Category A covers pathogens that can cause permanent disability, life-threatening illness or death. Category B covers materials that do not meet that high-risk threshold. Laboratory identification and the HMR’s detailed criteria should guide the final classification.
Must medical waste always carry an “INFECTIOUS SUBSTANCE” label?
No. If regulated medical waste is transported by a private or contract motor carrier and the outer packaging bears the “BIOHAZARD” marking required under 29 CFR 1910.1030, the “INFECTIOUS SUBSTANCE” label requirement may be waived.
What must employee training cover?
Training required under 49 CFR §172.704 must address hazardous material recognition, safe handling, packaging requirements and emergency response procedures so that transport operations remain compliant and safe.
